ANJANA PRAKASH ORAL JUDGMENT Date: 13-04-2015 The Petitioner seeks quashing of the order dated 27.03.2012 passed by the Sessions Judge, East Champaran at Motihari in Cr. Revision No. 33 of 2012 by which he has affirmed the order of cognizance dated 10.11.2011 passed by the Chief Judicial Magistrate, Motihari in Kalyanpur P.S. Case No. 49 of 2011. It has been submitted on behalf of the petitioner that the petitioner was not named in the First Information Report but subsequently his name transpired during investigation but final report was submitted in his regard. For the same occurrence, a
Patna High Court Cr.Misc. No.29034 of 2012 dt.13-04-2015 2/2 counter case was instituted also and a Title Suit is pending.
Since these are no cogent grounds for assailing the order of cognizance, the application is dismissed.
