Revision No. 33 of 2012 by which he has affirmed the order of cognizance dated 10.11.2011 passed by the Chief Judicial Magistrate, Motihari in Kalyanpur P.S. Case No. 49 of 2011. It has been submitted on behalf of the petitioner that the petitioner was not named in the First Information Report but subsequently his name transpired during investigation but final report was submitted in his regard.
