The petitioner apprehends his arrest in Mahammadpur P.S. Case No. 79 of 2016 instituted for the offence under Section 366(A) of the Indian Penal Code. It is alleged that the petitioner with other accused persons as named in the written report kidnapped grand daughter of the informant for purpose of marriage and kept her at unknown place. The statement of victim girl on her recovery has been recorded under Section 164 of Cr.P.C which has been filed as Annexure-2. The victim girl has neither taken name nor levelled any allegation against this petitioner. The informant has merely raised suspicion against this petitioner that he has taken his grand

Patna High Court Cr.Misc. No.3172 of 2017 (2) dt.03-02-2017 2/2 daughter for purpose of marriage. In the circumstances, prayer of the petitioner for anticipatory bail is allowed. In the event of surrender/arrest of the petitioner, named above, within six weeks from today in connection with Mahammadpur P.S. Case No. 79 of 2016, he shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-1st, Gopalganj, subject to the conditions as laid down under Section 438(2) Cr.P.C.
