JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-12-2018 The petitioner seeks regular bail in connection with Beur P.S. Case No. 156 of 2018, G.R. No.3298/2018, registered for offences punishable under Sections 302, 120(B), 34 of the Indian Penal Code and Section 27 of the Arms Act. Allegation as per F.I.R. is that the informant received an information that some mishaps have been occurred to his son and thereafter the informant started searching him and found him in injured condition and petitioner and several other persons were standing there and after seen him, they started to flee away. It is also alleged that his injured brother has stated that due to the money dues with Sanjay and Guddu, they have fired upon him.

Submission of learned counsel for the petitioner is that F.I.R. itself shows that the petitioner is not the assailant in

Patna High Court Cr.Misc. No.67090 of 2018(3) dt.05-12-2018 2/2 this case and furthermore, no specific allegation has been attributed to him and the petitioner is in judicial custody since 02.06.2018.

Heard learned A.P.P. also, who opposed the prayer for bail of the petitioner on the ground that several injuries were found on the person of the deceased which appears from the postmortem report.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Sub Judge VIII, A.C.J.M., Patna, in connection with Beur P.S. Case No. 156 of 2018, G.R. No.3298/2018, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
