The petitioner has preferred this application for grant of regular bail in a case registered under sections 307, 341, 325, 324, 504 and 34 of the Indian Penal Code.

As per the prosecution case, it is stated that the accused Vishal Kumar Singh ie the son of the petitioner started to abuse and assault the son of the informant. Thereafter, it is stated that other accused including the petitioner herein who happens to be the father of Vishal Kumar Singh joined in, they caught hold of the son of the informant and as a result of assault with a knife by the aforesaid accused, Vishal Kumar Singh the son of the informant was seriously injured.

It is submitted by learned counsel for the petitioner

Patna High Court CR. MISC. No.52899 of 2021(2) dt.09-03-2022 2/2 that the petitioner has been falsely implicated in the case only for the reason that he happens to be the father of the F.I.R. named accused Vishal Kumar Singh. The main allegation of assault is on Vishal Kumar Singh and not the petitioner herein. The petitioner is in custody since 29.3.2021 and has no criminal antecedent. Chargesheet has been submitted in the case. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the main allegation being against Vishal Kumar Singh and the petitioner having remained in custody for over 11 months, the Court directs the petitioner to be enlarged on bail in connection with Nagar P.S. Case no.167 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Katihar.
