JUSTICE ARUN KUMAR ORAL ORDER 29-01-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Kahalgaon (Ghogha) PS Case No. 183 of 2017 registered under Sections 302, 504, 506/34 of the IPC and Section 27 of the Arms Act. The allegation against the petitioner in brief is that he intercepted the informant and her husband in the way and Gonar Mandal and Makhan Mahdal both shot at causing his death. Learned Counsel for the petitioner submits that the deceased was himself a man of criminal background and the petitioner has been implicated due to enmity as father of the petitioner was killed by the deceased.

Learned Counsel for the petitioner submits that there is direct and specific allegation against the petitioner. Having considered the aforesaid facts and circumstances and the specific allegation of shooting at the deceased by the petitioner the prayer for bail of the petitioner is rejected. Since charge has been framed the trial court is directed to expedite the trial and preferably conclude the same preferably within a period of two years.
