Petitioner seeks regular bail in connection with Bahadurganj P.S. Case No. 179/2021 registered for the offences punishable under Sections 272, 273 of the Indian Penal Code 1860, Sections 30(a), 36 and 41 of the Bihar Prohibition and Excise Act, 2016.
The Police intercepted a car which was being driven by the petitioner and recovered a total quantity of 153 litres of illicit foreign liquor from the same.
Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he has not committed any offence in the manner alleged. He further
Patna High Court CR. MISC. No.52703 of 2021(2) dt.29-04-2022 2/2 submits that the petitioner was plying the vehicle at the instance/instruction of its owner and was not aware about the illicit liquor being kept therein. He next submits that the petitioner is not the owner of the vehicle, he is in custody since 23.6.2021 and charge sheet has already been submitted. Regards being had to the submission made by the parties and taking into consideration the materials on record, the fact that the petitioner has got no criminal antecedent, he is in custody since 23.6.2021 and charge sheet has already been submitted, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bonds of Rs.20,000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of learned ADJ-II cum Special Judge (Excise), Kishanganj, in connection with Bahadurganj P.S. Case No. 179/2021.
