JUSTICE BIRENDRA KUMAR ORAL ORDER 07-12-2016 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 420 and 409/34 of the Indian Penal Code.

The petitioners are Manager and Clerk posted in Madhya Bihar Gramin Bank. The informant is Manager of the said bank. Allegation is that the petitioners sanctioned and disbursed loan in favour of the applicants for purchase of cattle. Submission of the petitioners is that the loan amount has been paid through cheque to the vendor of the cattle on production of receipt of purchase by the loanee. Moreover, the actual purchase is verified by the Veterinary Doctor who put punch mark on the purchased animals.

No.52541 of 2016 (2) dt.07-12-2016 Considering the aforesaid facts, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad/Successor Court in connection with Shakurabad Police Station Case No. 97 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
