2. The petitioner seeks regular bail in connection with Shahpur Patori P.S. Case No. 133 of 2025 registered for the offence under Sections 109, 126(2), 115(2), 117(2), 303(2), 352, 61(2) of the BNS.

3. As per the prosecution case, the petitioner along with other co-accused persons allegedly formed an unlawful assembly, assaulted the victim, looted cash of Rs. 1,30,000/- and ornaments including a gold chain and bracelet and co-accused Pintu fired at the victim causing serious injury.

4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence.

Patna High Court CR. MISC. No.42958 of 2025(3) dt.03-09-2025 2/2 Petitioner is in custody since 11.04.2025. He further submits that the petitioner without accepting his guilt, is ready to return a part of the alleged looted amount i.e., Rs. 1 Lakh to the informant.

5. Learned A.P.P. for the State has vehemently opposed the prayer for bail.

6. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.

7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.,, Shahpur Patori, Samastipur/concerned Court below in connection with Shahpur Patori P.S. Case No. 133 of 2025 subject to condition that:- (I). At the time of furnishing the bail bonds, the petitioner shall produce a demand draft of Rs.1,00,000/- (Rs. 1 Lakh) prepared in the name of the informant. If the petitioner produces the aforesaid demand draft, the Court below shall accept his bail bonds and hand over the said demand draft to the informant.
