The petitioner has prayed for bail in a case registered for the offence punishable under sections 302, 201 and 34 of the Indian Penal Code.

As per allegation in the FIR, petitioner is brother-inlaw of the deceased and he along with other family members has tortured in various ways to the daughter of the informant and ultimately she was being killed by them.

Learned counsel appearing on behalf of the petitioner has submitted that petitioner is brother-in-law of the deceased and has been falsely implicated in this case. He has never forced the deceased to demand any thing from h er parental house. The sole responsibility to take care of wife is upon her husband and

Patna High Court CR. MISC. No.48793 of 2023(2) dt.04-08-2023 2/2 not against other family members. Husband has already been acquitted by the trial court vide judgment dt. 13.09.2021 passed in S.T. No. 01 of 2021. Petitioner is languyishing in judicial custody since 27.02.2023.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned CJM, Madhepura in connection with Madhepura (Bharahi) P.S. Case No. 1051 of 2019.
