JUSTICE SUDHIR SINGH ORAL ORDER 07-12-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.
The petitioner is apprehending his arrest in connection with Gamharia P.S. Case No. 87 of 2016 for the offences instituted under Sections 147, 148, 149, 341, 342, 348, 353, 323, 386, 387, 307, 506 and 333 of the Indian Penal Code. The prosecution case, in brief, is that the accused persons caught hold the informant and dragged and assaulted him and threatened him to sign on a paper otherwise he would be killed and due to fear they obtained the signatures of the informant on blank papers and thereafter threatened to set fire to the ballot boxes, Block office and police station if re-election is not held. The informant further came to know from the staffs of the office that several other accused persons along with 4-5 thousand unknown persons were involved in the alleged

It has been submitted on behalf of the petitioner that the petitioner has falsely been implicated in the present case. There is no allegation of tampering of witnesses alleged against the petitioner. No injury is said to have been caused by the petitioner in the alleged occurrence. The incident is said to have been taken place in connection with Panchayat election. The petitioner has been made accused due to political rivalry. The other co-accused have been granted bail vide Annexure-4 series to the present application.
On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Gamharia P.S. Case No. 87 of 2016 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-IV, Madhepura, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
