The petitioner apprehends his arrest in a case registered for the offence punishable u/s 341/323/353/34 of the IPC and section 37(c) of Bihar Prohibition and Excise Act, 2016. 3.
Prosecution case, in short is that, petitioner and one Gaurav Kumar were teasing a girl on the road, for which, they were being beaten up by the police. When the informant (In charge S.I. of Traffic Police force) reached there, he found that the petitioner was in a drunken position and he started misbehaving with the informant and thereafter fled away. The co-accused was apprehended on the spot.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. He
Patna High Court CR. MISC. No.44256 of 2023(2) dt.22-08-2023 2/2 has been falsely implicated in this case. No such occurrence, in the manner as alleged, has ever taken place. The allegation leveled against the petitioner is not specific rather general and omnibus in nature. It is submitted that though the case is of the year, 2019 and anticipatory bail application was filed in the year, 2023 but such delay of more than three years has caused as the petitioner is working in the C.R.P.F. and due to work pressure, he could not file the bail petition earlier. Petitioner has no criminal antecedent.

Learned APP for the State opposed the prayer for bail. 6.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/Successor Court in connection with Bhagwan Bazar P.S. Case No.119 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Anjani Kumar Sharan, J) pallavi/- U T
