JUSTICE PRABHAT KUMAR JHA ORAL ORDER 17-09-2016 Heard learned counsel for the petitioners, learned counsel appearing for the informant and the learned A.P.P. Learned counsel for the petitioners seeks permission to withdraw the Anticipatory Bail Petition of petitioners no. 1, 2 and 3, who surrendered in the court below and they were granted regular bail by the learned court below.
On the other hand, learned counsel for the informant pointed out that the present Anticipatory Bail Petition was filed on 23.08.2016 in this Court. Petitioners no. 1, 2 and 3 surrendered in the court below on 29.08.2016 and 30.08.2016 but they did not make any statement to this effect that they had earlier moved before this Court for grant of anticipatory bail.
Patna High Court Cr.Misc. No.39732 of 2016 (2) dt.17-09-2016 2/2 Of course, it appears that there is a concealment of facts on the part of petitioners no. 1, 2 and 3 as they did not disclose the same at the time of filing of regular bail petition before the court below.
Be that as it may, prayer is allowed. Anticipatory Bail Petition of petitioners no. 1, 2 and 3 is dismissed as withdrawn.
Learned counsel for the petitioners seeks permission to withdraw the Anticipatory Bail Petition of petitioner no. 4. Prayer is allowed.
The Anticipatory Bail Petition of petitioner no. 2 is dismissed as withdrawn.
