2. By order dated 27.03.2025, a report had been called for from the office of Superintendent of Police, Samastipur in connection with Sessions Trial No.67 of 2001 arising out of Bibhutipur P.S. Case No.134 of 1999 as to whether appellant is alive or not.

3. I find from the records that a letter dated 15.04.2025 has been sent by the Superintendent of Police, Samastipur to this Court annexing a report of the Inspector of Police, Bibhutipur Police Station dated 13.04.2025 wherein it has been mentioned that the sole appellant of the present appeal, namely, Babloo Yadav had been murdered on 27.03.2013 with respect to which a substantive FIR was also lodged. A charge-

Patna High Court CR. APP (SJ) No.565 of 2010(7) dt.10-10-2025 2/2 sheet of the said Bibhutipur P.S. Case No.59 of 2013 has also been annexed along with the said report.

4. In view of the aforesaid facts, there is no reason to doubt the factum of the death of the sole appellant, hence Cr. Appeal (SJ) No.565 of 2010 stands abated.

5. Let the records of Cr. Appeal (SJ) No.565 of 2010 be consigned to the record room.
