The first information report was lodged against unknown persons for offences under sections 302/201 of the Indian Penal Code. During the investigation, the name of the petitioner and other accused persons surfaced, Police submitted the Final Form and the court below on the basis of materials available on record took cognizance for the aforesaid sections.

In such view of the matter, this Court is not inclined to interfere with the order of cognizance.

Accordingly, this petition is dismissed. However, liberty is given to the petitioners to raise all points at the appropriate stage. (Shivaji Pandey, J) Mahesh/- U T
