JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-01-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

Petitioner is apprehending his arrest in connecation with Dulhin Bazar P.S. Case No. 116 of 2014, registered for offences punishable under Sections 409 and 420 of the Indian Penal Code. It has been submitted on behalf of the petitioner that even on a bare perusal of the First Information Report; it will appear that the present case has been lodged against the petitioner only on the basis of suspicion. The petitioner after transfer gave charge as per procedure and also submitted the last page of cash book to Nazir, who misappropriated the same for which an F.I.R had also been lodged against the Nazir, who later on deposited the misappropriated money and petitioner due to suspicion has been implicated in the present case.

In view of the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period six weeks, be released on provisional bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Sri Rahul Kumar learned Judicial Magistrate-1st Class, Danapur in connection with Dulhin Bazar P.S. Case No.

116 of 2014, till submission of charge-sheet subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure and also on condition that he will cooperate in the investigation of the case and make himself available before police as and when required and after submission of charge-sheet, he will have to surrender before the Court below and make prayer for regular bail, which will be considered by the learned Court below on its own merit on the basis of materials available in the case diary and record. With the above observation, this application is disposed of.
