The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 323, 379, 406, 420, 468, 504, 506/34 of the Indian Penal Code. The prosecution case is that marriage of informant's daughter was agreed to perform with petitioner no.4 Ramesh Sharma and, thereafter, articles worth Rs.40,000/- was given to the petitioners. Subsequently, demand of Rs.50,000/- was made when the informant demanded back the articles given earlier then he was assaulted and articles were not returned. It is submitted by learned counsel for the petitioners that there is nothing on record to suggest that the marriage was
Patna High Court Cr.Misc. No.55677 of 2015 (2) dt.08-12-2015 2/2 finally fixed between the petitioner no.4 and daughter of the informant. There is no proof with regard to alleged payment made to the petitioners and petitioner nos. 1 to3 are parents and brother of petitioner no.4.
Considering the nature of accusation, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Ara, Bhojpur in connection with Agion(G) P.S. Case No.61 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
