Petitioner is accused in Mahua Police Station Case No 75 of 2017 registered for the offence punishable under Section 379 of Indian Penal Code.

First information report is in relation to stolen motorcycle against unknown persons. Counsel for the petitioner submits that subsequent upon his arrest in Mahua Police Station Case No 149 of 2017, he has been remanded in the instant case merely on suspicion even though recovery of the motorcycle has not been made from his possession. He is in custody since 04.07.2017 and in the other case mentioned in paragraph 3 of the petition pending against him, he is on bail.

Considering the submissions made on behalf of the

Patna High Court Cr.Misc. No.60140 of 2017 (2) dt.19-12-2017 2/2 petitioner, prayer for bail is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in Mahua Police Station Case No 75 of 2017 subject to the following conditions:

(1) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(2) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
