Mr. Md. Aslam Ansari ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 15-06-2021 Heard Mr. Uday Shankar Singh, learned counsel for the petitioners and Mr. Md. Aslam Ansari, learned APP for the State.

The petitioners seek bail in anticipation of their arrest in connection with Bheldi P.S. Case No. 08 of 2020 instituted for the offences under Sections 304(B), 201/34 of the Indian Penal Code.

The petitioners are not related to either the deceased or her in-laws. It has been alleged in the First Information Report that when the parents and other relatives of the deceased visited her matrimonial home, the petitioners misbehaved and assaulted them.

Learned counsel for the petitioners has submitted

Patna High Court CR. MISC. No.39061 of 2020(3) dt.15-06-2021 2/2 that only because one of the associates of the petitioners had mediated the marriage, the petitioners also have been made accused in this case.

Considering the aforesaid aspect of the matter, one of the similarly situated co-accused person, namely, Mohar Ray @ Manoharlal Ray has been granted anticipatory bail by the court below.

Considering the fact that the petitioners are in no way related to the deceased or her in-laws, they are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -XII, Saran at Chapra, in connection with Bheldi P.S. Case No. 08 of 2020, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
