Prayer for bail of petitioner, who is the husband of deceased, was earlier rejected by this Court by order dated 04.05.2018 in this case registered under Sections 304B/34 of Indian Penal Code.
Petitioner's counsel submits that injuries reported in the post mortem indicate that the death of the victim is suicidal. The victim daughter of the informant suffered homicidal injuries in her Sasural. She was married with the petitioner in the year, 2014. Prosecution case is of repeated demand of dowry. Petitioner, being the husband, owes primary responsibility for the safety of his wife.
Patna High Court CR. MISC. No.72374 of 2018(5) dt.15-05-2019 2/2 This Court has called for a report regarding stage of the trial. The same has been received. From the report, it is apparent that the trial has commenced and witnesses are being examined and cross-examined.
The petitioner is in custody since 27.10.2017. Having considered the submission of the parties, this Court is not inclined to allow the prayer for bail. Same is again rejected.
