JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-12-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Rule 3 and 5 of The Bihar Excise (Mahua Flowers) Rules, 2006.
From an auto rickshaw, 14 bags of Mahua flower were recovered when the driver of the vehicle escaped from the scene. The petitioner is the owner of the vehicle in question. It is submitted by learned counsel for the petitioner that under an agreement, alleged auto rickshaw was being played by one Pintu Kumar Singh, hence the recovery cannot be treated from the possession of the petitioner. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.

Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Katihar Muffasil P.S. Case No. 122 of 2015 pending in the court of learned JM, 1st Class, Katihar. Accordingly, the application is disposed of.
