The petitioner is languishing in custody since 31.07.2018 in a case registered for the offences punishable under Sections 420 and 406 of the Indian Penal Code. The prosecution case is that the petitioner took Rs.5,53,000/- as consideration amount for transferring a certain piece of land and consequently, an agreement to sell was executed between the petitioner and the informant. Subsequently, the transfer was not made and the petitioner returned Rupees One Lac, but remaining amount i.e., Rs.4,53,000/- has not been returned to the informant. Patna High Court Cr.Misc. No.67559 of 2018(6) dt.20-02-2019 2/2 availed and the investigation has already been concluded. It is further submitted that the petitioner is accused in one other case, apart from the present case.
Learned counsel for the informant submits that the petitioner taken the amount fraudulently from the informant and has not returned remaining Rs. 4,53,000/- taken for transfer of a particular piece of land.
Considering the accusation being arising out of contractual nature of dispute and the investigation being concluded, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-XII, Bhojpur at Ara, in connection with Chandi P.S. Case No. 67 of 2018.
