1. Heard learned counsel for the parties.
2. The petitioner in this application prays for grant of anticipatory bail apprehending his arrest in connection with Barauni P.S. Case no. 485 of 2023, registered under sections 302, 304B, 498A and 34 of the Indian Penal Code and sections 3 and 4 of the Dowry Prohibition Act.
3. As per the prosecution case, the informant states that his daughter, who was married to one Sujit Kumar, was tortured
Patna High Court CR. MISC. No.46277 of 2024(2) dt.16-07-2024 2/3 by the accused persons including the petitioner herein. The said Sujit Kumar made a demand of Bullet motorcycle. The informant's daughter was done to death by the accused persons after strangulating her.
4. Learned counsel for the petitioner submits that the petitioner happen to be the mother-in-law of the deceased. The allegations are general and omnibus in nature. The husband of the deceased is in custody. Charge-sheet has been submitted in the case. It is further submitted that coaccused husband of this petitioner Devan Mahto and the petitioner's son Parshu Ram Mahto have been enlarged on bail vide order dated 12.3.2024 passed in Cr.Misc. no.14502 of 2024. The petitioner has no criminal antecedent.
5. The application for bail is opposed by learned A.P.P for the State.
6. Having heard learned counsel for the parties and taking into consideration the allegation in the F.I.R., the petitioner who is a lady not having any criminal antecedent, the husband of the deceased being in custody and grant of bail to the above named coaccused, it is directed that the petitioner, above named, in the event of her arrest or surrender before the learned Court below within a period of four weeks, be released
