JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-12-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 409 of the Indian Penal Code.
The prosecution case is that co accused Krishnakant Yadav, Block Statistical Officer cum Incharge of Purchase centre, Ben and petitioner being Executive Assistant were deputed in the purchase centre, Ben. It is alleged that they purchased 39082.83 quintals of paddy during procurement year 2012-13 but they supplied only 37437.83 paddy to the rice millers and thereby misappropriated 9645 quintals of paddy worth Rs.1,25,82,020.00.
Patna High Court Cr.Misc. No.57188 of 2015 (2) dt.18-12-2015 2/2 It is submitted by the learned counsel for the petitioner that the calculation is imaginary and the incharge of the purchase centre was aforesaid Krishnakant Yadav.
Considering the nature of accusation, let the learned court below consider the prayer for regular bail of the petitioner in case the petitioner surrenders within six weeks from today in connection with Ben P.S. Case No. 27 of 2015 pending in the court of learned C.J.M. Nalanda at Biharsharif. This application is disposed of with the aforesaid observation/direction.
