JUSTICE ARUN KUMAR ORAL ORDER 16-01-2018 Heard learned Counsel for the petitioners and the State. Petitioners, already in custody, seeks bail in Tajpur (Waini) PS Case No. 197 of 2016 registered under Sections 302/34 of the IPC.

Learned Counsel for the petitioners submits that the petitioners are not named in the FIR, petitioner No. 1 is brother of the deceased and other petitioners are his sons. Specific suspicion is raised against other brothers, who are named in the FIR, only suspicion is raised later on against the petitioners. Petitioner No. 1 is 70 years old. The petitioners are in custody since 8.8.2017. Having considered the said facts and circumstances, the petitioners, namely, Jitendra Jha, Chandan Jha alias Chandan Kumar Jha and Prashant Jha @ Deva Nand Jha @ Prashant Kumar Jha are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) by each one of them with two sureties of the like amount each to the satisfaction of ACJM lst Samastipur in connection with Tajpur (Waini) PS Case No. 197 of 2016.
