The petitioner is apprehending his arrest in connection with Kinjer P.S. Case No. 63 of 2016 registered for the offence punishable under Section 414 of the Indian Penal Code and under Section 7 of the E.C. Act.

Learned counsel for the petitioner submits that the allegation that the petitioner was carrying rice, which belongs to sale through PDS, is wholly misconceived. The petitioner is an agriculturist and the rice weighing 2 quintals and 50 Kgs. was his own agricultural produce and the person, the PDS dealer from whose stock, it is said to be seized has not yet been examined, in connection with the present case.

No.41537 of 2016 (2) dt.24-10-2016 2/2 Considering the remote nature of allegation made and that the petitioner has no criminal antecedent, let the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Arwal in connection with Kinjer P.S. Case No. 63 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
