The petitioner is apprehending his arrest in connection with Complaint Case No.91 of 2017 registered for offences punishable under Sections 3⁄4 of the D.P.Act. Allegation against the petitioner is of demand of dowry and subjecting her cruelty for that and further allegation is that he has illicit relationship with his Bhabhi.

Submission of the learned counsel for the petitioner is that the whole allegation is false and concocted and he has no illicit relationship with his Bhabhi and the whole allegation has been made only to get advantage to the O.P.no.2 not to reside with the petitioner and as per information of the petitioner, she has already solemnized marriage with another person . Patna High Court CR. MISC. No.41572 of 2019(4) dt.19-09-2019 2/2 O.P.no.2, who is also submitted that she is not ready to reside with the petitioner but submitted that her articles and the ornaments be returned to her..

Having heard both sides and in view of the facts and circumstances, as stated above, this application is disposed of with direction to the petitioner to surrender on 14.10.2019 and on that day O.P.o.2 shall also appear before the learned court below and the petitioner shall be released on provisional bail for a period of four months on that day and during that period, the learned court below shall send the matter to the District Mediation Centre that both the parties shall appear before the Mediation Centre to return of the articles of the O.P.no.2 by the petitioner, Mediation Centre will submit a report to the learned court below and once being satisfied with the report, the learned court below shall confirm the provisional bail of the petitioner, otherwise he is free to pass any other order or orders as he deems fit and proper.

With the aforesaid direction, this application is disposed of.
