JUSTICE HEMANT KUMAR SRIVASTAVA) 06-02-2019 The office has reported that period of sentence is 10 years and, therefore, the appeal against impugned Judgment and sentence order is maintainable before the Single Bench. Learned counsel for the appellant points out that to convert this appeal into Criminal Appeal (SJ) fresh token is needed, which is not possible unless memo of appeal is returned to the appellant.

In view of the aforesaid submissions as well as facts and circumstances of the case, let the memo of appeal be returned to learned counsel for the appellant within a week, so that he could convert this appeal into Criminal Appeal (SJ) with fresh token number.
