The petitioner seeks bail in connection with a case, registered for the offence punishable u/s 395, 397 of the IPC. 3.
As per the prosecution case, on the point of pistol, five unknown persons took away the vehicle owned by the brother of the informant.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has not committed any offence as alleged in the FIR. F.I.R. is lodged against unknown persons and the name of petitioner has transpired in this case on the confessional statement of the apprehended co-accused. No such
Patna High Court CR. MISC. No.48762 of 2024(2) dt.07-08-2024 2/2 occurrence in the manner as alleged, has ever taken place. He has been falsely implicated in this case due to ulterior motive. There is general and omnibus allegation against the petitioner. The petitioner has no criminal antecedent and has been languishing in custody since 06.02.2024 and some of the coaccused have been granted regular bail by co-ordinate Bench of this Court.

Learned APP for the State opposed the prayer for bail. 6.
Considering the facts and circumstances of this case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/Successor Court in connection with Wazirganj P.S. Case No.639 of 2022.
