This application, for grant of anticipatory bail, arises out of Goraul P.S. Case No. 335 of 2015, disclosing offences under Sections 147, 148, 149, 341, 323, 353, 307, 332, 337, 427 and 504 of the Indian Penal Code and Section 3/4 of the Damage to Public Property Act.
Learned counsel for the petitioners has submitted that in similarly circumstanced other co-accused persons have been granted the privilege of anticipatory bail by this
Patna High Court Cr.Misc. No.44609 of 2016 (2) dt.27-10-2016 2/2 Court vide orders, dated 06.05.2016, passed in Cr. Misc. No. 20168 of 2016 (Mukul Kumar & Anr. Vs. The State of Bihar), and 30.09.2016, passed in Cr. Misc. No. 42749 of 2016 (Ramesh Kumar Vs. The State of Bihar).
Considering the submission, as above, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Vaishali at Hajipur, in connection with Goraul P.S. Case No. 335 of 2015, subject to the condition laid down under Section 438
(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioners shall present themselves before the police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
