The petitioner apprehends his arrest in Chautham P.S. Case No.124 of 2018 registered under Sections 308, 379, 323 and other sections of the Indian Penal Code.
The informant named the petitioner and other accused persons and alleged that they all assaulted the informant and others for partition of the land. The petitioner is alleged to have assaulted the father of the informant with iron rod on his head. Learned counsel for the petitioner submits that there is a counter version being Chautham P.S. Case No.123 of 2018 on account of land dispute.
It appears that both parties entered into a scuffle with each other for partition of land and the petitioner is alleged to have assaulted the father of the informant with iron rod on his
Patna High Court CR. MISC. No.40642 of 2019(2) dt.02-07-2019 2/2 head and from perusal of injury report, it appears that the father of the informant got grievous injury on his head on account of assault made by the petitioner.
Having considered the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
