JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-04-2019 This application, for grant of anticipatory bail, arises out of Complaint Case No. 577 of 2018, disclosing offences under Sections 498(A) and 323 of the Indian Penal Code and Section 4 of Dowry Prohibition Act.

Earlier vide order dated 17.12.2018, petitioner and the victim were directed to appear before the court of Sub Divisional Judicial Magistrate, Vaishali at Hajipur and if the victim appears on the said date, the petitioner shall take her to his home and shall keep her with full honour and dignity. Submission of learned counsel for the petitioner is that the daughter of the complainant did not appear in the court below and due to which, he could not took her to his house.

In such view of the matter, both petitioner and the victim are directed to appear before the Sub Divisional Judicial Magistrate, Vaishali at Hajipur on 22.04.2019 and the petitioner shall file a petition to the effect that he is ready to keep the victim with himself with full honour and dignity and if such an application is filed and if the petitioner will be ready take the victim with himself, the court below shall release him on provisional bail for a period of six months to his own satisfaction and the court below shall call upon both the parties in the first week of each month and find out the status of matrimonial life of the parties and if after six months, the court below is satisfied with the matrimonial life of the parties as well as the conduct of the parties, he will confirm the provisional bail of the petitioner otherwise, he is free to pass any order as he deems fit and proper including the cancellation of bail bond of the petitioner.
