Petitioner seeks bail in a case registered for the offences punishable under Sections 304(B/ 201/34 of the Indian Penal Code.
Wife of this petitioner died after eight years of her marriage. Allegation is of demand of dowry and torture for the same.
Submission is that the presumption of dowry death is not there against the petitioner and there is no witness of the occurrence of death. The FIR was lodged after cremation of the dead body. The petitioner is in custody since 12.01.2018. Considering the aforesaid material, let the petitioner, above named, be released on bail on furnishing bail
Patna High Court CR. MISC. No.69811 of 2018(5) dt.11-04-2019 2/2 bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Kowakole Police Station Case No.22 of 2016 and S.Tr. No.162 of 2018, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
