The learned counsel for the petitioner after some argument seeks permission to withdraw the bail application and fairly submits that trial is going on and out of total seven prosecution witnesses, three witnesses have been examined and allegation is recovery of 3.9 k.g. of Charas from the petitioner. Permission is accorded.

Accordingly, this bail application is dismissed as withdrawn, with a direction to the learned Court below to ensure that the trial is concluded expeditiously within a period of nine months from today and the NCB is directed to ensure that the
