The petitioner seeks bail in connection with Beur P.S. Case No. 184 of 2020 instituted for the offences under Sections 400 and 412 of the Indian Penal Code read with Sections 25(1b)a and 26 of the Arms Act. Learned counsel for the petitioner submits that the petitioner is in custody since 01.08.2020, charge-sheet has been submitted in the case and has antecedent of one case. No.52998 of 2021(2) dt.14-02-2022 2/3 dacoity in P.N.B. is standing near Mahavir Colony turning point, accordingly the petitioner was arrested and a loaded countrymade pistol was recovered from him. It is further alleged that the petitioner disclosed that in the bank dacoity case his share was Rs. 7 lakhs and he received Rs. 1,50,000/- and the rest was to be paid by Aman, further at the instance of the petitioner, Rs. 90,000/- was recovered from his house.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the bank dacoity case also, the F.I.R. was instituted against unknown, the petitioner was arrested in the present case and it is alleged that a countrymade pistol was recovered from him and the police made him confess his crime in the bank dacoity case and thereafter manipulated the present F.I.R.

Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 01.08.2020 and charge-sheet has been submitted in the case, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III,

Case No. 184 of 2020 with a condition that one of the bailor shall be the father of the petitioner (Chandeshwar Patel) and if the petitioner is implicated in a case of similar nature, the learned court will forthwith cancel his bail bonds.
