JUSTICE MOHIT KUMAR SHAH ORAL ORDER 21-12-2017 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Sheohar P.S. Case No.177 of 2017 instituted for the offences under Section 354(A), 354(B) of the Indian Penal Code, Section 54 of the Bihar Prohibition and Excise Act, 2016 and Section 12 of POSCO Act..

The allegation is regarding recovery of liquor from the room of the petitioner.

The learned counsel for the petitioner submits that one occurrence has led to two F.I.Rs., one regarding allegation of misbehaviour with a girl alleged to be kept in the said room and

It is submitted that the petitioner has been granted bail in the case pertaining to misbehaviour with the girl. It is contended that barring the aforesaid other case, the petitioner has got a clean antecedent and is languishing in custody since 11.10.2017. Considering the nature of accusation, the period of custody already undergone and the fact that he has already been enlarged on bail in the other case, I direct the petitioner named above to be released on regular bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of Additional District and Sessions Judge 1st cum Special Judge, Special Judge, Sheohar in connection with Sheohar P.S.
