The petitioners seek bail in anticipation of their arrest in connection with Ahiyapur P.S. Case No. 60 of 2021 instituted for the offences punishable under Sections 272,273,420,467,468,471/34 of the Indian Penal Code and Section 30(a)/36/41 of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioners submits that the name of the petitioners have been mentioned by the accused who was arrested at the site. The accused has made all several persons as accomplice, neither the motorcycle belongs to the petitioners nor the place where the liquor was recovered belongs

Having considered the submissions and taking into consideration the aforesaid aspects, exfacie case under Section 30(a) of the Act is not made out against the petitioners, I am inclined to allow the petitioners on bail, in the event of arrest they shall be released on anticipatory bail, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
