The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 504, 506, 507, 379/34 of the Indian Penal Code.
The prosecution case is of assaulting the informant with fists and lathi. When father of the informant came to save the informant, he was assaulted by the accused persons. Petitioner no. 1 Sudhir Singh @
Patna High Court Cr.Misc. No.56517 of 2015 (2) dt.14-12-2015 Sudhir Kumar, snatched gold chain from the neck of the informant. Petitioner no.2 Pakija Singh assaulted with iron rod on the head of the informant.
It is submitted by the learned counsel for the petitioners that there is counter version of the occurrence also. The opinion of the medical report has not been received. Specific accusation of assault is against petitioner no. 2 Pakija Singh.
Let the learned court below consider the prayer for regular bail of the petitioner no. 2, if he surrenders before the learned court below within a period of six weeks from today in connection with Maranchi P.S. Case No. 42 of 2015, pending in the court of learned Sri Rajesh Kumar Verma, J.M., Ist Class, Barh, Patna So far as petitioner no. 1 is concerned, only allegation against him is for snatching gold chain, statement has been made in para-3 of the petition that petitioner has no criminal , let the above named petitioner no. 1 be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sri Rajesh Kumar Verma, J.M., Ist Class, Barh, Patna in connection with Maranchi P.S. Case No. 42 of 2015, subject to conditions as laid down under Section 438(2) of the Code of
Patna High Court Cr.Misc. No.56517 of 2015 (2) dt.14-12-2015 Criminal Procedure.
