Petitioner is apprehending his arrest in a case registered for the offences punishable under Section 379 of the Indian Penal Code.

The prosecution case is that theft being committed of the transformer coil. The First Information Report was registered against unknown. The stolen coil was recovered from the scrap shop of Md. Mahfuz Alam @ Munna Jee. The petitioner was working on the shop of the petitioner. Recovery cannot be treated from the possession of the petitioner. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent.

The aforesaid facts constitute ground for consideration of prayer for regular bail of the petitioner, if the

Patna High Court Cr.Misc. No.55851 of 2015 (2) dt.09-12-2015 petitioner surrenders before the learned court below within a period of six weeks from today in connection with Bachwara P.S. Case No. 120 of 2015, pending in the court of learned Chief Judicial Magistrate, Begusarai.

With this observation this application is disposed of.
