Petitioners are apprehending their arrest in a case registered for offences punishable under Sections 147, 148, 149, 337, 504 and 506 of the Indian Penal Code and Section 27 of the Arms Act.
It has been submitted on behalf of the petitioners that out and out false and frivolous allegations have been levelled against these petitioners and no specific allegation has been attributed against the petitioners. It has also been submitted that the informant only to save his skin from the earlier case filed by the
Patna High Court Cr.Misc. No.52944 of 2016 (3) dt.11-01-2017 2/2 petitioners against the informant, has filed the present frivolous case.
Heard learned A.P.P. also.
Having heard both sides. In view of the facts and circumstances of the case, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within a period six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Kahalgaon P.S. Case No. 358 of 2015, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
