JUSTICE ARUN KUMAR ORAL ORDER 23-01-2018 Heard learned Counsel for the petitioner and the State as also the learned Counsel appearing on behalf of the informant. Petitioner, already in custody, seeks bail in Narari (Kala Khurd) PS Case No. 47 of 2017 registered under Section 302/34 of the IPC.

The allegation in brief is that the informant's father went along with his brother in the field for agriculture purpose, his brother returned back but the father did not return in the evening or night and in the morning his dead body was found thrown in the field after killing him, then the informant's brother disclosed that previous day in the evening he saw this petitioner going in that direction armed with deadly weapon.

Learned Counsel for the petitioner submits and except suspicion raised by brother of the informant, that too after recovery of the dead body, there is no other material against the petitioner. As disclosed in the FIR due to land dispute the petitioner has falsely been implicated and he has no criminal antecedent.

Patna High Court Cr.Misc. No.59983 of 2017 (3) dt.23-01-2018 Having considered the said facts and circumstances, the petitioner, namely, Murli Singh is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Aurangabad in connection with Narari (Kala Khurd) PS Case No. 47 of 2017.
