This application is for grant of regular bail in connection with Gardanibagh P.S.Case No.230 of 2014 corresponding to G.R.No.3738 of 2014, for the offences punishable under Sections 304(B)/34 of the Indian Penal Code. Earlier the prayer for bail of the petitioner was rejected on merit.
Submission of the learned counsel for the petitioner is that no progress has been made in the trial though the charge has been framed in September, 2015.
Heard learned A.P.P. also.
Having heard both sides and in view of fact that earlier the prayer for bail of the petitioner was rejected on merit, I
Patna High Court Cr.Misc. No.54128 of 2017 (2) dt.15-11-2017 2/2 am not inclined to grant bail to the petitioner, however, the learned trial court is directed to expedite the trial and try to conclude it as soon as possible probably nine months.
At the same time, the Sr.S.P., Patna has to see that the witnesses are produced on the date fixed in the court concerned so that the trial may be concluded. Both the learned court below and the Sr.S.P., Patna are directed to submit progress report to this Court in each month so that the Court may watch progress in the case. With the aforesaid observation, this application is dismissed.
