2. This application has been filed for modification of order dated 07.10.2024 passed in Cr. Misc. No. 68161 of 2024 by which the petitioner was granted regular bail in connection with Noorsarai P.S. Case No. 206 of 2024.

3. Learned counsel for the petitioner has submitted that the petitioner was granted regular bail vide order dated 07.10.2024 in Cr. Misc. No. 68161 of 2024. In paragraph no. 7 of that order, it was observed that before accepting the bail bond, the criminal antecedent(s) of the petitioner shall be verified and if it is found that he is involved in any other case, except which has been mentioned in paragraph-3 of this petition, his bail bonds shall not be accepted.

4. Learned counsel has submitted further that even after

Patna High Court CR. MISC. No.43231 of 2025(4) dt.22-08-2025 2/2 eight months, the criminal antecedent of the petitioner could not be verified and he is still under custody.

5. Considering the above-mentioned facts and circumstances, paragraph-7 of the order dated 07.10.2024 passed in Cr. Misc. No. 68161 of 2024 is modified to the extent indicated below.

"The petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Nalanda at Biharsharif in connection with Noorsarai P.S. Case No. 206 of 2024, subject to the condition that the petitioner shall cooperate in the disposal of the trial and make himself available as and when required by this Court.

6. If the petitioner is found involved in any other case except those which have been mentioned in paragraph no. 3 of the bail petition, his bail bond shall be liable to be cancelled."

7. Accordingly, the modification application stands allowed.
