2. The present petition has been filed for quashing the order dated 02.03.2024 passed by learned Sub Judge-XIV, Patna in Title Partition Suit No. 172 of 2021, whereby and whereunder the learned trial court has rejected the petition dated 23.01.2023 filed by the petitioners under Order 7 Rule 11 of the Code of Civil Procedure. Against such an order, a civil revision petition under Section 115 of Code of Civil Procedure would lie.

3. In these circumstances, learned counsel for the petitioners seeks permission to convert the present civil miscellaneous petition into civil revision petition.

4. Permission is accorded.

5. Learned counsel for the petitioners is directed to convert the present civil miscellaneous petition into civil
