JUSTICE PARTHA SARTHY ORAL ORDER 02-03-2021 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. The petitioner has filed the instant application for grant of regular bail in connection with Goraul (Katahara O.P) P.S. Case no. 322 of 2019 registered under sections 354B, 354D and 506 of the Indian Penal Code read with sections 3 and 4 of the POCSO Act As per allegation in the FIR, the allegation against the petitioner is of misbehavior with the minor informant. It is submitted by learned counsel for the petitioner that the allegation as levelled in the FIR are false and concocted. The petitioner is a victim of dirty village politics. There is an unexplained delay in lodging of the FIR, the petitioner has no criminal antecedent and is in custody since 25.8.2020.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the nature of allegation together with the petitioner being in custody since 25.8.2020, the Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Goraul (Katahara O.P) P.S. Case no. 322 of 2019 on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge 1st-cum-Special Judge, Vaishali at Hajipur.
