Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 338, 379, 325, 307, 504, 506/34 of the Indian Penal Code.

The prosecution case is that while the informant after withdrawal of Rs. 14,000/- from the bank was returning with his cousin son-in-law, when petitioners stopped the informant.

Raghunandan Yadav put his hand in the pocket of the informant, petitioner no. 1 Gurudyal Yadav assaulted with bricks on the head of the informant, when petitioner no. 2 Raghunandan Yadav took out Rs. 14,000/- from the pocket of

Patna High Court Cr.Misc. No.55870 of 2015 (2) dt.09-12-2015 the informant. Petitioner no. 3 Shyamsundar Sah also assaulted with lathi, causing fracture injury to the informant. It is submitted by the learned counsel for the petitioners that though one injury of the informant has been found to be grievous in nature. There is counter version of the occurrence. The case lodged by the petitioners' side is at earlier point of time.

The aforesaid facts constitute ground for consideration of prayer for regular bail of the petitioners, if the petitioners surrender before the learned court below within a period of six weeks from today in connection with Sono P.S. Case No. 95 of 2015, pending in the court of learned Additional Chief Judicial Magistrate, Jamui.

With this observation this application is disposed of.
