The petitioner seeks regular bail in connection with Bisfi PS case no. 123 of 2017 registered for the offence punishable under Sections 363, 366(A), 328, 376(D), 120(B)/34 of Indian Penal Code and Section 4 of POCSO Act. The case of the prosecution is that the prosecutrix had gone out of the house for the purposes of getting her cloth stitched and on the way, the petitioner and one other co-accused namely Kapil had waylaid her and taken her to Nepal, however subsequently, she was left at her aunt's place by the said accused persons.

No.69700 of 2018(3) dt.11-01-2019 2/2 The learned counsel for the petitioner submits that admittedly, no immoral act has been committed by the petitioner and the entire story appears to be concocted one. It is further submitted that the petitioner is having a clean antecedent and he is languishing in custody since 03.08.2018. Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.
Accordingly, the abovenamed petitioner is directed to be enlarged on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of 1st Addl. Sessions Judge-cumSpecial Judge, POCSO Act, Madhubani in connection with Bisfi PS case no. 123 of 2017.
