====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 24-11-2021 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

Learned counsel for the petitioner is expected to honour his undertaking to remove the defects, as pointed out by the office, when called upon to do so by the office.

The petitioner is apprehending his arrest in connection with Imamganj P.S. Case No. 75 of 2019 for the offence registered under Sections 147, 148, 149, 341, 323, 333, 337, 353, 427, 504 and 506 of the Indian Penal Code.

Learned counsel for the petitioner submits that earlier petitioner had moved before this Court by filing Cr. Misc. No. 71772 of 2019 along with 7 other petitioners. It is further submitted that due to inadvertance, the submission was made that this petitioner too was arrested along with Yogendra Bharti and the said application is

Patna High Court CR. MISC. No.4719 of 2021(2) dt.24-11-2021 2/2 against this petitioner and Yogendra Bharti was withdrawn. However, till date this petitioner has not been apprehended in connection with the present case. It is further submitted that similarly situated coaccused has been granted bail by a co-ordinate Bench of this court vide order dated 27.11.2019 passed in Cr. Misc. No. 71772 of 2019. It is further submitted that the petitioner has falsely been implicated in this case due to dirty village politics. It is further submitted that the petitioner has no concern with the unauthorized construction being done on the government land. It is further submitted that the petitioner has no criminal antecedent.

Considering the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest/surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Sherghati, Gaya in connection with Imamganj P.S. Case No. 75 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Sunil Kumar Panwar, J) Jagdish/- U T
