ANJANA PRAKASH ORAL JUDGMENT Date: 07-07-2015 The Petitioner seeks quashing of the entire proceeding including the order of cognizance dated 21.05.2001 passed by the Judicial Magistrate, 1st Class, 1st Class, Patna in Complaint Case No. 2108(C) of 2000. The case of the Complainant is that she had alleged some financial irregularities in the Complaint Petition. Subsequently, the matter was compromised between the parties and a withdrawal petition was filed in the Court below but till date no action has been taken in this regard.

On the last occasion, notices had been issued to the Opposite Party No. 2 but none appears on her behalf.

Patna High Court Cr.Misc. No.33493 of 2012 dt.07-07-2015 Having considered the documents filed herein showing that the Complainant is no longer interested in prosecuting the Petitioner, the entire proceeding as against all the accused persons including the order of cognizance dated 21.05.2001 passed by the Judicial Magistrate, 1st Class, 1st Class, Patna in Complaint Case No. 2108(C) of 2000 is, hereby, set aside.

The application stands allowed.
