This application for grant of anticipatory bail arises out of Mahua P. S. Case No. 452 of 2015, disclosing offences under Section 392 of the Indian Penal Code.

It is alleged that the miscreants, 3 in number, made a truck bearing Registration No. BR-31G-9975 plying on Mahua Tajpur Road near Malpur Chowk to stop and they thereafter snatched some cash from the driver at the point of pistol. One of the miscreants, namely Pankaj Kumar was apprehended with the help of the local people, whereas, others managed to flee away. The said Pankaj Kumar allegedly, disclosed the name of the petitioner to the local persons saying that he was also there along with other miscreants.

Learned counsel for the petitioner has submitted that the petitioner has no criminal antecedent and it has come subsequently that the petitioner's name was wrongly mentioned by said Pankaj Kumar.

Considering the above submission, this application is allowed. Let the petitioner above named in the event of his arrest/surrender within four weeks from today in the court below be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in Mahua P. S. Case No. 452 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the police/court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
