JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 27-10-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Sarsai P.S. Case No. 49 of 2016 registered under Sections 341, 323, 324 and 326 of the Indian Penal Code, pending in the court of J.M. Ist Class, Purnea.

The accusation is that when the informant, Gautam Kumar, went to attend the call of nature near canal, the petitioner came there and forcibly boarded him on motorcycle and took him at Bahora Ghat, where informant was forced to put the maize bags into thresher. In that course, one bag of maize was dropped from his hand then the petitioner gave iron plat blow at his left elbow.

No.44476 of 2016 (2) dt.27-10-2016 Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, his prayer for grant of anticipatory bail stands rejected. The petitioner is directed to surrender before the trial court within four weeks and pray for regular bail, which would be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
